BIDDER RULES

 

1) Telephone Bids will be taken beginning on Monday, November 26 at 9 a.m. and close at 5 p.m. on Wednesday, Nov. 28, 2007.  NO new telephone bidder registrations will be accepted after 5 p.m. on Wednesday Nov. 28.  However, if the final bid has not been determined by 5 p.m., bidding will continue with ONLY those bidders still live on that particular season.

 

2) Registration is essential for the telephone bidding and you must call the hotline to obtain your bidder number on Monday, Nov. 26.  Bidder hotline: 302-376-6289

 

3) All seasons marked with an asterisk (*) will be included in the Live Auction on November 30th at Keeneland Entertainment Center in Lexington, Kentucky.  In order to bid at the November 30th Live Auction you MUST either:  a) be the highest telephone bidder on that season at the close of the telephone auction or b) attend the event at Keeneland or c) send an agent to bid for you.  The highest telephone bidder on a season marked with an asterisk (*) will be called to participate by phone in the Live Auction at approximately 8 p.m. on November 30th so they must be near a phone to participate. 

 

4) All seasons are offered on a ³NO GUARANTEE² (NG) non-refundable basis except those marked (LF), which are sold ³Live Foal².  ALL seasons are payable in full by Jan. 5th, 2008.  All LF seasons are subject to stallion farm and TCA¹s approval of mare.  If the season is purchased LF and no foal results from the mating, the fee will be refunded upon TCA¹s receipt of a satisfactory veterinary certificate attesting to the mare¹s barrenness, abortion, death or failure to produce a live foal which stands alone and nurses.  In order to receive a refund for a LF season resulting in no foal, your mare must be bred at least twice to the stallion.  ³No Guarantee² purchase of stallion seasons are NON-REFUNDABLE UNDER ANY CONDITION including the unavailability, infertility or death of the stallion, or the mare¹s death, inability to conceive or carry to term, once named and covered.

 

5) Upon receipt of payment, TCA will notify the farm at which the stallion stands, of the name of the successful purchaser.  The purchaser is then solely responsible for completing and forwarding a Mare Information Form to the stud farm and making all booking arrangements.

 

6) Seasons to stallions standing in Kentucky are subject, under Kentucky law, to a 6% Kentucky Sales Tax, which will be billed in addition to the season purchase price.

 

7) Purchaser waives and releases TCA, its volunteers and the donor of the stallion season or auctioned item, from any and all liability in connection with the use of function ability of the stallion season or purchased item. 

 

8) Purchasers of stallion seasons agree to breed a thoroughbred mare on the purchased seasons only in conformity with the lawful restrictions imposed by the syndicate manager, syndicate owner or stallion manager at the stud farm involved, pursuant to the syndicate agreement and/or any other generally applicable agreement and management practice for the stallion involved.
